BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Sharwan Sah, applied for bail in a criminal case (Town PS Case No.519 of 2024) concerning alleged offences under Sections 140(3), 143(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 relating to the disappearance of an infant. The prosecution alleged that a guard, Jyoti Mishra, handed the baby to a lady in a red saree, and the petitioner was implicated solely on the basis of confessional statements of co‑accused persons, although his name does not appear in the FIR. The co‑accused, including Jyoti Mishra and others, had already been granted bail by the same court in earlier related matters. The petitioner argued that he has clean antecedents, has been in custody since 24‑09‑2025, and that the charge‑sheet has been filed. The Additional Public Prosecutor opposed bail, but the court considered the lack of direct evidence against the petitioner and the precedent of bail to co‑accused. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties of equal amount. The application for bail was therefore allowed.

Issues considered

  • Whether bail should be granted to the petitioner who is not named in the FIR and is implicated only through confessional statements of co‑accused.
