The Court granted bail to all three petitioners subject to a bail bond of Rs 10,000 and two sureties each.

Summary

The petitioners, Md. Jabir Alam, Md. Aijaj Alam and Md. Zameer Alam, were arrested in connection with a case registered under Sections 8(c) and 21(c) of the NDPS Act after narcotic resin (smack) was recovered from their persons. The quantities seized were 52.44 g, 124.78 g and 124.78 g respectively, which the petitioners argued were below commercial quantity and that they were falsely implicated. The State opposed bail, noting that petitioner 3 had two prior criminal cases while the others had no antecedents. The learned counsel for the petitioners highlighted that a co‑accused, Uttam Kumar, had already been granted bail in a related matter. After hearing both sides, the Court found the circumstances sufficient to justify bail and ordered the petitioners to be released on a bond of Rs 10,000 with two sureties each. The order was pronounced by Justice Ashok Kumar Pandey of the Patna High Court on 5 February 2026.

Issues considered

  • Whether bail should be granted to accused persons under Sections 8(c) and 21(c) of the NDPS Act when the seized quantity exceeds the ‘small quantity’ threshold but is less than ‘commercial quantity’.
  • Whether the presence of prior criminal antecedents for one of the accused warrants denial of bail.
