Patna High Court

Sardar Manohar Singh @ Manohar Singh BaggaversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the nature of the accusations warranted denial of relief.

Summary

The petition for anticipatory bail was filed by Sardar Iqbal Singh, who feared arrest in a case registered under IPC sections 406, 420, 504 and 34. The FIR alleged that the informant had given a friendly loan of Rs 7.5 lakh for house maintenance, of which only Rs 2 lakh was returned, and the balance remained unpaid. When the informant demanded the remaining amount, the petitioner allegedly abused and threatened him. The court noted the seriousness of the allegations involving criminal breach of trust, cheating, and intimidation. Considering the nature of the accusations, the court rejected the prayer for anticipatory bail. The petition was consequently dismissed.
