The court granted regular bail to the petitioner.

Summary

Arun Yadav applied for regular bail in a theft case under sections 331(4) and 305 of the B.N.S., where jewellery worth about eleven lakh was stolen from an informant's house. The FIR named unknown miscreants, but a co‑accused, Munna Kumar, gave a confessional statement implicating the petitioner; no material was recovered from the petitioner and he has been in judicial custody since 4 September 2025. The State opposed bail, citing ten prior criminal cases against the petitioner. The court, after hearing both sides, found the evidence against the petitioner insufficient beyond the co‑accused’s confession and ordered his release on regular bail with a bond of Rs 10,000 and two sureties, subject to conditions of cooperation and weekly police‑station attendance. The bail was granted despite the petitioner’s criminal antecedents.

Issues considered

  • Whether the petitioner is entitled to regular bail despite a co‑accused’s confessional statement naming him
  • Whether the petitioner’s prior criminal cases justify denial of bail
