Anticipatory bail was denied for Lalan Dev Rai and Dharam Dev Rai but granted to Ram Vakil Rai, with the application of Akhilesh Yadav withdrawn.

Summary

The Patna High Court heard two anticipatory bail applications arising from PS case No.107 of 2024, involving serious offences under the Bhartiya Nyaya Sanhita such as assault, homicide and related provisions. The petitioners Lalan Dev Rai and Dharam Dev Rai were accused of assault with a farsa leading to the victim's death, while Ram Vakil Rai and Akhilesh Yadav faced charges of assault with a pistol butt and a farsa. The court declined anticipatory bail for Lalan Dev Rai and Dharam Dev Rai, directing them to surrender within two weeks and seek regular bail. In the second application, the petitioners withdrew the request for Akhilesh Yadav, and the court granted anticipatory bail to Ram Vakil Rai subject to a Rs.10,000 bond and two sureties, invoking Section 482(2) of the BN S. The order was limited to the present applications and did not prejudice subsequent proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the accused in a case involving serious offences under the Bhartiya Nyaya Sanhita, including assault leading to death
