Patna High Court

Tabrej AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Tabrej Alam, was implicated in a case (PS Sugauli, Case No. 260 of 2021) involving alleged assault and multiple offences under the Indian Penal Code, including sections 143, 341, 323, 324, 307, 379, 504 and 506. He applied for anticipatory bail, asserting his innocence, claiming the injuries were minor, and highlighting his clean antecedents. The State opposed the bail application. The Court examined the nature of the alleged injuries, the petitioner’s clean record, and the statutory provisions governing anticipatory bail. Considering these factors, the Court granted anticipatory bail, directing that if arrested within eight weeks, the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the alleged offences and the nature of injuries.
  • Whether the petitioner’s clean antecedents and the minor nature of injuries justify the grant of anticipatory bail under Section 482(2) of the CrPC.
