Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the stipulated conditions.

Summary

Petitioner Firoz Ali was arrested in a case (PS Bheldi Case No. 113 of 2020) alleging assault with an iron rod on the son of an informant, invoking IPC sections 448, 341, 323, 325, 307 and 504/34. The petitioner claimed innocence, asserted that the injury was simple, and highlighted his clean antecedent. The State opposed his bail application. The Patna High Court, after considering the nature of the accusations, the extent of injury and the petitioner’s clean record, granted anticipatory bail. The order directed that, upon arrest or surrender within eight weeks, the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
