Patna High Court

Vishal Chupal @ Vishal KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail and ordered his release on bail subject to the stipulated conditions.

Summary

Vishal Chupal, the petitioner, feared arrest in a case (PS No. 122 of 2024) involving alleged offences under several IPC sections, including rioting, assault, and criminal intimidation. The prosecution alleged that 17 persons, including the petitioner, assaulted the victim and the informant. The petitioner claimed innocence and that he was falsely implicated. The High Court, after hearing counsel, allowed the bail application. The court directed that if arrested or surrendered within four weeks, the petitioner be released on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438(2) of the Code of Criminal Procedure, 1973.
  • Whether the nature of the alleged offences under the IPC justifies denial of bail.
