BAIL GRANTED

Holding

The court ordered the release of the petitioner on bail with conditions.

Summary

The petitioner, Munindra Kumar Goit, was arrested in connection with a robbery and conspiracy case (Khajauli P.S. Case No. 25 of 2024) involving alleged theft of jewelry from a shop owned by an informant. He is charged under Sections 395 and 397 of the Bihar Negotiable Instruments Act, Section 120(B) of the Indian Penal Code, and Section 27 of the Arms Act. The petitioner contended that he was falsely implicated, had no physical possession of the stolen items, no prior similar criminal record, and that a title suit existed between the informant and his brother. The State opposed bail, citing the seriousness of the offences. The court, after considering the facts, granted regular bail on a bond of Rs.10,000 with two sureties, subject to the petitioner’s cooperation with the trial process.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under Sections 395, 397, 120(B) and 27 Arms Act
  • Whether the petitioner poses a flight risk or risk of tampering with evidence
