Lalti DeviversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court refused to grant anticipatory bail to the petitioners.

Summary

The petitioners, Lalti Devi and Vishnudev Ray, father‑in‑law and mother‑in‑law of a deceased woman, applied for anticipatory bail fearing arrest in a dowry‑death case (Salimpur PS Case No. 58 of 2025) under sections 80, 302 and 34 of the Indian Penal Code. They argued that they lived separately from the deceased and, being merely in‑laws, should be granted bail. The court examined the nature of the alleged offence—torture and murder for dowry—and considered the relationship between the accused and the victim. Finding no sufficient ground to extend the privilege of anticipatory bail, the judge declined the application. The petitioners were ordered to surrender within five weeks and to seek regular bail thereafter.
