BAIL GRANTED

Holding

Bail was granted to the petitioner subject to the conditions of Section 438(2) CrPC and Section 482 BNSS.

Summary

The petitioner, Veer Kumar, was arrested in connection with a case registered under sections 137(2), 96, 3(5) of the Bihar Narcotic Substances Act and sections 8 and 12 of the POCSO Act, alleging kidnapping of a minor girl. The petitioner contended that he was falsely implicated and that the girl’s statement indicated she had eloped with him. The State opposed his bail application. The Court examined the allegations and the petitioner's claim of innocence, and, applying the provisions of Section 438(2) of the CrPC and Section 482 of the BNSS, allowed the bail application. The Court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the conditions prescribed. The order was made by Justice Sandeep Kumar of the Patna High Court.
