BAIL GRANTED

Holding

Bail was granted to the petitioners subject to the conditions prescribed under Section 438(2) CrPC and Section 482 BNSS.

Summary

The petitioners, Balmukund Prasad Gupta and Dhiraj Ranjan, sought bail fearing arrest in Bangaon Police Station Case No. 165 of 2024, which alleged offences under sections 308(2), 308(4), 126(2), 351(2), 352, 115(2) and 3(5) of the Bihar Negotiable Sale and Transfer Act (BNSS). They were accused of torturing the second opposite party, Rupa Kumari, who also claimed the petitioners were involved in the killing of her husband, a separate pending case. The State opposed bail, emphasizing the seriousness of the allegations. The Court, after considering the totality of circumstances, allowed the bail application, directing the petitioners to surrender within four weeks, furnish a bail bond of Rs.10,000 with two sureties, and comply with conditions under Section 438(2) of the CrPC and Section 482 of the BNSS.

Issues considered

  • Whether bail should be granted to the petitioners under Section 438(2) of the CrPC and Section 482 of the BNSS despite the serious nature of the alleged offences.
