Anticipatory bail is granted to the petitioners.
Summary
The petitioners, Rajveer Singh and Karamveer Singh, sought anticipatory bail after being implicated in a murder case under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act, alleging they only dragged the informant’s grandfather from a vehicle while the co‑accused shot him. They contended that the allegations were politically motivated, that there was no pre‑meditated conspiracy or overt act on their part, and that the deceased had already been granted regular bail in a related proceeding. The State and the informant opposed the bail, arguing the seriousness of the offences. The Court, after considering the facts and the general nature of the accusation, allowed the petition for anticipatory bail. The order directed that, if arrested within eight weeks, the petitioners be released on bail upon furnishing a Rs 10,000 bond with two sureties each, subject to conditions under Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under the alleged offences.
- Whether the petitioners were involved in the alleged murder and thus liable for arrest.
- Whether the allegations constitute a cognizable offence warranting denial of bail.

3(5) of the B.N.S. and Section 27 of the Arms Act.

behalf of the petitioners that petitioners are quite innocent and
have committed no offence. Petitioners have falsely been
implicated in this case due to political rivalry. As a matter of
fact, on the alleged date and time of occurrence, these
petitioners were peacefully accompanying the election
campaign convoy of co-accused Anant Singh and the convoys
of both the political parties accidentally came face to face,
resulting in a spontaneous verbal hot talk exchanged between
supporters of both the sides. The alleged incident took place
spontaneously and there is no premeditated conspiracy or
common object attributed to these petitioners. It is further
submitted that petitioners are not alleged to have committed any
overt act. They are only alleged to have dragged the deceased
out of the vehicle and thereafter, co-accused Anant Singh shot
the deceased, who has already been granted regular bail by a
Co-ordinate Bench of this Hon’ble Court vide order dated
19.03.2026 passed in Cr. Misc. No. 835 of 2026.

prayer for grant of anticipatory bail to the petitioners.
