The Court granted bail to the petitioners subject to a Rs. 10,000 bond, two sureties and surrender within four weeks.
Summary
The petitioners Vinod Singh, Pintu Singh and Amit Rao, along with Mukul Singh, applied for bail in two criminal miscellaneous cases (Nos. 52278 and 52372 of 2025) arising from a Bagaha police case alleging offences under various sections of the Bihar Negotiable Sale (BNS) Act, the Arms Act and the Indian Penal Code, stemming from a road‑rage incident in which they were accused of firing at an informant's vehicle, assaulting persons and looting Rs. 90,000. The petitioners contended that they were falsely implicated and that no injury was caused, seeking release on bail. The State opposed the bail on grounds of the seriousness of the charges. The Court, after hearing counsel, allowed the bail applications, directing that the petitioners surrender within four weeks and furnish a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the BNS Act. The order was pronounced by Justice Sandeep Kumar.
Issues considered
- Whether bail should be granted to the petitioners despite the nature of the offences alleged under the BNS Act, Arms Act and IPC provisions.
- Whether the conditions prescribed under Section 438(2) CrPC and Section 482 BNS are satisfied.
- Whether the petitioners pose a flight risk or threat to the investigation.
