Patna High Court

Arun SahversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that no fresh ground was shown to reconsider the earlier order, and therefore the bail application was rejected.

Summary

Arun Sah was arrested in connection with an NCB case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, facing charges under Sections 20(b)(ii)(c), 25, 29 and 8(c). He applied for regular bail, but a coordinate bench of the Patna High Court had earlier rejected his bail application on 19 March 2025. The petitioner sought a fresh consideration of bail, arguing that there were new grounds. Justice Nawneet Kumar Pandey examined the application and found no fresh ground to revisit the earlier order. Consequently, the bail application was dismissed and the earlier rejection upheld.

Issues considered

  • What are the grounds, if any, for granting regular bail to a person accused under the NDPS Act?
  • Whether the petitioner has raised any fresh material or circumstances warranting a re‑consideration of the earlier bail denial?
