Holding

Anticipatory bail was denied and the application dismissed.

Summary

The petitioner, Pashupati Nath Gupta, applied for anticipatory bail fearing arrest in a case (PS Case No.125/2025) registered under sections 126(2) and 127(2) of the BNS for alleged molestation of a four‑year‑old child. He pleaded innocence, asserted a clean antecedent and claimed false implication. The learned counsel for the State opposed the bail, emphasizing the seriousness of the alleged offences. Justice Sandeep Kumar, after hearing both sides, declined to grant anticipatory bail, directing the petitioner to surrender within two weeks and seek regular bail, failing which the police would arrest him. The order was communicated to the Superintendent of Police, Gopalganj for compliance.
