Holding

The Court held that there is no ground to cancel the anticipatory bail as no allegation of evidence tampering is substantiated.

Summary

The petitioner, Shesh Nath Dwivedi, filed an application seeking cancellation of the anticipatory bail granted to the respondent, Monu Dubey, in a case involving offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The ground for cancellation alleged by the petitioner was the alleged tampering with evidence by the respondent. The High Court examined the records and found no allegation or material indicating that the respondent had tampered with evidence. Consequently, the Court held that there was no substantive basis to interfere with the earlier anticipatory bail order. The application for cancellation was therefore dismissed, leaving the anticipatory bail in force.
