Patna High Court

Santosh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Regular bail was granted as the victim’s statement did not specifically implicate the petitioner and a co‑accused had previously been released on bail in a similar matter.

Summary

The petitioner, Santosh Kumar, was charged with rape and related offences under Sections 376, 506, 34 of the IPC, several provisions of the SC/ST (Prevention of Atrocities) Act, and Sections 4, 6, 8, 10, 14 of the POCSO Act. He sought regular bail, claiming innocence and alleging that the victim’s statement under Section 164 of the CrPC did not identify him as an assailant. The petitioner also highlighted that a co‑accused, Mritunjay Pandey, had been granted bail in a similar case by a coordinate bench. The State opposed the bail application, emphasizing the seriousness of the offences. The Court, considering the victim’s non‑identification of the petitioner, the precedent of bail to the co‑accused, and the circumstances of the case, ordered the release of the petitioner on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted to an accused of rape and related offences under the IPC, SC/ST Act and POCSO Act.
  • Whether the victim’s statement under Section 164 of the CrPC, which does not identify the petitioner, is sufficient to deny bail.
  • Whether the grant of bail to a co‑accused in a similar case warrants bail to the petitioner.
