Decided
Disposal
BAIL GRANTED

Holding

The Court held that regular bail should be granted to the petitioners subject to strict conditions.

Summary

The High Court heard two related bail applications arising from PS‑86/2025 in Tandwa, Aurangabad, where the petitioners, Nishant Kumar and Mithun Kumar, were accused of assaulting an informant and his wife on 6 July 2025. The prosecution alleged offences under sections 191(2), 126(2), 115(2), 75 and 109(1) of the Bharatiya Nyaya Sanhita, 2023, claiming the victims sustained head injuries. The petitioners contended they were falsely implicated, that the allegations were vague and collective, and highlighted that the injuries were simple and that co‑accused had already been granted anticipatory bail. After considering the submissions, the Court granted regular bail to both petitioners on a bond of Rs 10,000 with two sureties, imposing conditions of trial cooperation, surety relations, affidavit disclosures, and non‑tampering with evidence. The applications were allowed, and the bail orders were issued subject to the stipulated conditions.

Issues considered

  • Whether the petitioners are entitled to regular bail despite the seriousness of the offences under the Bharatiya Nyaya Sanhita.
  • Whether the allegations against the petitioners are sufficiently specific to deny bail.
  • Whether the grant of anticipatory bail to co‑accused influences the decision on regular bail.
