The court granted regular bail to the petitioner.

Summary

The petitioner, Gulshan Kumar, sought regular bail in a case registered under section 304 of the Indian Penal Code concerning the alleged theft of a golden chain. The prosecution alleged that a boy snatched the chain from a woman, and a gold-like chain was later recovered from the petitioner’s possession. The petitioner claimed innocence, arguing that the FIR was lodged against unknown miscreants, no TIP was conducted, and he was framed due to his six prior criminal antecedents. The State opposed the bail, citing the seriousness of the offence and the petitioner’s criminal record. After hearing both sides, the court granted regular bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, physical presence at trial, and weekly attendance at the police station.
