Tanveer KhanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioners, ordering their release on bond.

Summary

The petitioners, Tanveer Khan and Sujeet Kumar, were arrested in connection with a kidnapping and ransom demand case where three unknown persons abducted the victim's brother, demanded Rs. 50 lakh, and threatened his life. They are charged under Section 140(2) of the BNS and Sections 25(1‑b)a, 26 and 35 of the Arms Act. The petitioners claim they were falsely implicated, noting that the victim’s testimony and the TIP did not identify them, and that only co‑accused Chotu and Raushan named them in confessional statements. Having been in custody since 30‑04‑2025, they sought regular bail. The Court, after considering the lack of direct identification and the petitioners’ antecedents, ordered their release on bail with a bond of Rs. 10,000 each and two sureties, subject to cooperation with the trial.

Issues considered

  • Whether regular bail should be granted to the accused under Section 140(2) of the BNS and the specified sections of the Arms Act in a kidnapping‑ransom case.
  • Whether the evidence, including the victim’s identification and co‑accused statements, is sufficient to justify continued detention.

                       3. As per allegation, while the informant’s brother

was on his way back home, three-four unknown accused

persons forcibly made him sit in the car and took him

towards Dehri. At around 10.10.p.m in night, an anonymous

call was made to the wife of the victim and asked for

ransom of Rs. 50 lakh and also threatened to eliminate the

victim, if the matter was reported to the police.

                       4. The learned counsel for the petitioners has

submitted that the petitioners are innocent and have falsely

been implicated. There is nothing against them in the entire

case diary, except some criminal antecedents. Co-accused

Chotu and Raushan were arrested and they named the

petitioners in their confessional statements. The victim in

the TIP identified five accused persons, including Chotu and

Raushan. In TIP, the petitioners were not identified by the

victim, whereas other co-accused persons were identified.

The petitioners are in custody since 30.04.2025.

                       5. Considering the above facts and circumstances,

let the petitioners, above-named, be released on bail on

furnishing bail bond of Rs. 10,000/-(ten thousand) each,
