Patna High Court

Ranjeet kumar @ Ranjit kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner with conditions.

Summary

Petitioner Ranjeet Kumar was charged under Sections 366(A) and 34 of the Indian Penal Code for allegedly enticing away a minor girl for the purpose of marriage. He contended that the marriage was consensual, that he was falsely implicated, and that the victim gave birth to a child who later died, with the petitioner now pregnant. The informant’s counsel admitted that the marriage had indeed taken place. The court examined the facts, noting the marriage and the petitioner’s claim of innocence, and considered the nature of the offence and the need for his presence in trial. Accordingly, the court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to his cooperation in the trial.
