Patna High Court

Arun KumarversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the procedural deficiencies, the non‑commercial quantity of the seized narcotic, and the completed investigation, bail should be granted to the petitioner.

Summary

Arun Kumar was arrested in connection with a case under the NDPS Act for alleged possession of 17 kg of poppy straw. He applied for bail, contending that the seizure was made without a preliminary test, that mandatory provisions under Section 42 of the NDPS Act were not complied with, and that the quantity seized was below the commercial threshold, rendering Section 37 inapplicable. The prosecution opposed bail, but the court noted the lack of proper sampling, the completed investigation, and the petitioner’s clean antecedent. Considering these factors and the prolonged custody since 13 June 2025, the court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under CrPC Section 437(3) and BNSS Section 480(3).

Issues considered

  • Whether bail should be granted in an NDPS case where procedural lapses such as non‑compliance with Section 42 are alleged
  • Whether the quantity of poppy straw being less than commercial quantity negates the application of Section 37 of the NDPS Act
  • Whether the petitioner’s prolonged pre‑trial custody justifies the grant of bail
