Patna High Court

Ranveer Kumar @ ChhavilalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, subject to a bail bond and sureties.

Summary

The petitioner, Ranveer Kumar, was arrested on 1 April 2025 in connection with a case registered under the Arms Act for alleged possession of an un‑cartridged pistol. He applied for regular bail, claiming innocence and alleging that co‑accused had been granted bail in similar circumstances by a coordinate bench of the same court. The petitioner’s counsel argued that the bail should be granted on the same footing as the co‑accused. The court considered the allegations, the precedent of bail granted to the co‑accused, and the statutory provisions of the Arms Act. It ordered that the petitioner be released on bail upon furnishing a bail bond of Rs 10,000 with two sureties of equal amount, subject to his cooperation in the trial. The order was pronounced by Justice Nawneet Kumar Pandey.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Arms Act provisions (Sections 25(1‑B)(a), 26, 35).
  • Whether the bail granted to co‑accused in similar cases mandates bail for the petitioner.
