Ajad Paswan @ Aajad KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

In the absence of any material linking the petitioner to the offence beyond a co-accused’s confession, and considering his clean antecedents and parity with co-accused, anticipatory bail under Section 482(2) of the B.N.S.S. is warranted.

Summary

Ajad Paswan sought anticipatory bail fearing arrest in a case registered under Sections 303(2), 317(2) and 3(5) of the B.N.S., where stolen household items were recovered from a co-accused, Tuntun Mahto, who implicated the petitioner in his confession. The petitioner argued that no material other than the co-accused’s confession linked him to the offence, that no stolen articles were found in his possession, and that he had clean antecedents, noting that similarly situated co-accused had earlier been granted anticipatory bail. The State opposed the bail. The court, considering the lack of substantive evidence, the petitioner’s clean record and parity with other co-accused, allowed the anticipatory bail under Section 482(2) of the B.N.S.S., subject to a bail bond and two sureties, and imposed conditions for cancellation if criminal antecedents or false statements were later discovered.

Issues considered

  • Whether anticipatory bail can be granted when the only incriminating material is a co-accused’s confessional statement.
  • Whether the petitioner’s clean antecedents and parity with co-accused justify the grant of anticipatory bail.
  • Whether Section 482(2) of the B.N.S.S. empowers the court to grant anticipatory bail in such circumstances.

this case merely on the basis of confessional statement of co-

accused Tuntun Mahto. Save and except confessional statement,

there is no material on record to show the complicity of this

recovered from possession of this petitioner. It is further

submitted that similarly situated co-accused persons has already
