Patna High Court

Md. ArsadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bail bond and sureties.

Summary

The petitioner, Md. Arsad, sought anticipatory bail after being implicated in a case alleging assault on his brother‑in‑law, the informant, with a wooden plank. The prosecution alleged offences under several sections of the B.N.S., while the petitioner claimed innocence, asserting the complaint was fabricated due to a family feud and that the injuries were minor. The informant’s counsel opposed bail, but the court considered the relationship between the parties and the nature of the injuries. The court held that the circumstances warranted the grant of anticipatory bail. Accordingly, the petitioner was ordered to be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S.

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the B.N.S.S. in view of the alleged offences and the nature of the complaint
