Holding

The petitioner is entitled to regular bail and is released on furnishing the prescribed bond and sureties.

Summary

Vikash Kumar (also known as Ranveer Kumar) was arrested in connection with a murder case (Ramkrishna Nagar PS Case No. 597 of 2024) under Sections 103(1), 61(2), 351(2), 3(5) of the BNS and Section 27 of the Arms Act. The deceased, a witness in a separate case, was allegedly threatened by Sonu Kumar and his family, who later fired at his house, resulting in his death. The petitioner claims he was falsely implicated and that only Sonu and his relatives discharged the firearm; Sonu and his brother have already been granted bail by coordinate benches. The State opposed the bail application. The Court, after considering the facts, ordered the petitioner’s release on regular bail with a bond of Rs.10,000 and two sureties, subject to his cooperation in the trial.

                                    2. In this case, the petitioner is seeking regular bail

in connection with Ramkrishna Nagar P.S. Case No. 597 of

2024, registered for the offences punishable under Sections

                   103(1), 61(2), 351(2), 3(5) of the BNS and 27 of Arms Act.

to his house and narrated the entire occurrence to his family

members. It is alleged that on the same day, at about 9:00 PM,

          deceased, who died.

                         4. The learned counsel for the petitioner has

submitted that the petitioner is innocent and has falsely been

implicated. There is allegation against six persons of opening

fire at the deceased, but only one injury was there on the person

of the deceased. It was Sonu, who was accused in the earlier

case. Sonu and his family members threatened the deceased to

withdraw that case. Said Sonu Kumar has been granted bail by a

coordinate Bench of this Court in Cr. Misc. No. 53908 of 2025.

          21.07.2025.

                        5. On the other hand, the learned APP for the State

has opposed the prayer for bail.

                         6. Considering the above-mentioned facts and

circumstances, let the petitioner above-named be released on

bail on furnishing bail bonds of Rs.10,000/- with two sureties
