Pawan ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Pawan Manjhi was arrested in connection with a murder case where the FIR alleged that fifteen accused, including him, assaulted the deceased, with one co‑accused using an axe and the petitioner allegedly brandishing a pistol. The petitioner pleaded that he is innocent, did not assault the deceased and has a clean antecedent record. He had been in custody since 17 March 2025 and pointed out that other similarly situated co‑accused had already been granted bail. The learned counsel for the petitioner prayed for regular bail, emphasizing his non‑involvement in the assault and his clean background. Considering these facts, the court ordered his release on bail of Rs 10,000 with two sureties, subject to his cooperation with the trial and availability before the court.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious offences alleged under the Indian Penal Code.
  • Whether the petitioner’s clean antecedents and alleged non‑participation in the assault justify granting bail.
