Patna High Court

Suman Kumar SahuversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for anticipatory bail, imposing bail bond, sureties, and a maintenance condition.

Summary

The petitioner, Suman Kumar Sahu, sought anticipatory bail fearing arrest in a dowry harassment case (IPC 498A) arising from Complaint No. 269 of 2022. The prosecution alleged that the petitioner and others assaulted the victim to demand dowry. The petitioner contended innocence and lack of specific allegations against him. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, the Court granted anticipatory bail subject to a bail bond, two sureties, and a condition to pay monthly maintenance of Rs. 8,000 to the complainant. The order also stipulated that the maintenance direction is subject to any decision of the Family Court and that non‑compliance could lead to cancellation of bail.

Issues considered

  • What is the appropriateness of granting anticipatory bail under Section 438 CrPC to the petitioner accused under IPC Section 498A?
  • Whether the Supreme Court precedent in Arnesh Kumar v. State of Bihar governs the grant of anticipatory bail in this case.
