Patna High Court

Arvind Kumar @ Arvind RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

Arvind Kumar was implicated in a case (Siwan Muffasil P.S. Case No. 351 of 2025) alleging his involvement in the self‑immolation death of Bablee Kumari, who allegedly committed suicide after he refused to marry her. The FIR charges him under Sections 64, 108 and 62 of the B.N.S. The petitioner, a 19‑year‑old student with no prior criminal record, sought anticipatory bail fearing arrest. The State argued that the petitioner’s refusal led to the victim’s extreme act. The Court, after hearing both sides, granted anticipatory bail subject to a bond of Rs. 10,000 with two sureties and imposed conditions regarding appearance, non‑tampering with witnesses, and refraining from further offences.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the FIR.
  • Whether the allegations under Sections 64, 108 and 62 of the B.N.S. constitute a case where bail can be denied.
