Patna High Court

Ram Sagar Yadav @ Ramsagar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to anticipatory bail if arrested within eight weeks, subject to a bail bond and sureties.

Summary

The petitioner, Ram Sagar Yadav, a brother‑in‑law of the complainant, sought protection from arrest in a dowry‑related complaint (Cr. Misc. No. 5515 of 2026) alleging offences under IPC sections 323, 498A, 504, 506 and Dowry Prohibition Act sections 3 and 4. The complainant’s husband had already been granted anticipatory bail by a coordinate bench of the Patna High Court. The petitioner argued he had no involvement in the family affairs and was a separate mess owner. The court examined whether the petitioner’s apprehension of arrest justified anticipatory bail despite the serious nature of the allegations. Considering his lack of direct involvement, the court ordered that if he is arrested within eight weeks, he may be released on bail with a bond of Rs 10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S.S., 2023.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the complaint alleging serious offences under the IPC and Dowry Prohibition Act.
  • Whether the petitioner’s relationship to the complainant and lack of involvement in family affairs justify granting bail.
