Decided

BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and sureties.

Summary

The petitioner, Anil Mahto, was charged under several sections of the Indian Penal Code for allegedly inflicting a rod blow on an informant, causing injuries. He had been in custody since May 18, 2025 and claimed the injuries were simple and that there was a case and counter‑case between the parties. The petitioner, a person of clean antecedent, applied for bail, while the State opposed the application. The court examined the nature of the alleged offences, the petitioner’s background, and the circumstances of his detention. Considering these factors, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to his cooperation with the trial.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the charges under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) of the IPC.
