DISMISSED

Holding

The Court held that bail could not be granted in the present circumstances and dismissed the application.

Summary

The petitioners, Md. Aftab Alam and Hani Raj, applied for bail in connection with Sugauli Police Station Case No. 425 of 2023, which involves an alleged dacoity under Section 395 of the Indian Penal Code. Both had previously been denied bail in earlier applications dated 23.10.2024 and 11.09.2024. The petitioners argued that the charge had been framed and that the trial was underway, seeking relief from custody. The Court noted the seriousness of the offence, the self‑incriminating statements of the petitioners, and the fact that the trial had already commenced, concluding that granting regular bail would be inappropriate. Consequently, the Court dismissed the bail applications and directed the Superintendent of Police to ensure witness attendance to avoid trial delays.

Issues considered

  • Whether bail should be granted to the accused in a dacoity case punishable under Section 395 IPC after the charge has been framed and trial commenced.
