BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond, sureties, and conditions of cooperation with the trial.

Summary

Petitioner Pawan Mandal was arrested under IPC Section 354 and Section 8 of the POCSO Act for allegedly enticing and teasing the informant’s 11‑year‑old daughter. The petitioner claims he is innocent and was framed due to village politics, having been in custody for seven months. The informant’s counsel presented the victim’s statement recorded under CrPC Sections 164 and 161, alleging misconduct by the petitioner. The court examined the seriousness of the allegations, the length of pre‑trial detention, and the possibility of the petitioner cooperating with the trial. It ordered the petitioner’s release on bail upon furnishing a Rs.10,000 bond with two sureties, subject to his cooperation and non‑tampering with evidence.

Issues considered

  • Whether bail should be granted in a case involving alleged sexual assault of a minor under the POCSO Act and outraging modesty under IPC Section 354
  • Whether the petitioner’s claim of false implication and prolonged pre‑trial custody justify bail
