Patna High Court

Pankaj Kumar Ray @ Sonu NigamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Pankaj Kumar Ray, sought regular bail in a case registered under sections 379 and 411 of the Indian Penal Code, alleging that he was falsely implicated. The prosecution alleged recovery of a loaded pistol, a motorcycle and a mobile phone from his possession. The petitioner claimed innocence, highlighted that he had been in custody since 29‑12‑2023, and pointed out that a co‑accused in the same case had been granted bail earlier. The State opposed the bail application. Considering the length of custody, the petitioner’s claim of innocence, and the precedent of bail to the co‑accused, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear at the police station monthly.

Issues considered

  • Whether bail should be granted to the petitioner in a case under sections 379 and 411 of the IPC given the nature of the alleged offences and the period of custody.
  • Whether the petitioner’s claim of false implication and the prior grant of bail to a co‑accused warrant the release on bail.
