BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners subject to a bail bond and sureties under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners, three residents of Chormara village, sought anticipatory bail after being named in an FIR alleging that they, armed with lathis and dandas, assaulted an informant and his family. The FIR listed offences under Sections 147, 148, 149, 341, 323, 307, 354, 504, 506 and 447 of the Indian Penal Code. The petitioners contended that the allegations were false, the injuries were minor, and they had a clean antecedent. The State opposed the bail application, arguing the seriousness of the charges. The Court, considering the nature of the accusations, the minor injuries, and the petitioners' clean record, granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, with conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
