The Court granted anticipatory bail to the petitioner with specified conditions.
Summary
The petitioner, Amrendra Kumar Singh, sought anticipatory bail fearing arrest in a case (Karakat P.S. Case No. 397 of 2025) filed under sections 132, 223, 189(2) and 352 of the BNS and section 8(2) of the N.H. Act, arising from a road‑blocking incident after a vehicular accident. The prosecution alleged that the petitioner, a passer‑by with prior criminal antecedents, was instrumental in obstructing traffic, thereby hampering emergency services. The petitioner contended that he was implicated merely because of his past record and offered to contribute Rs. 2,000 to the Chief Minister’s Relief Fund. The State opposed bail, emphasizing the petitioner’s alleged role in the obstruction. The Court, noting the omnibus allegation and the petitioner’s undertaking to appear in trial, granted anticipatory bail subject to a payment of Rs. 2,000 to the relief fund and a series of strict conditions, including bail bond, sureties, regular appearances, and non‑interference with witnesses.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under the circumstances.
- Whether the petitioner poses a risk of tampering with evidence or influencing witnesses.
- Whether the conditions imposed, including payment to the relief fund, are lawful and appropriate.

and have been named in the FIR as a person who was

has to be blamed as they allow plying of vehicle on the wrong

busy road but that cannot be a ground, once accident happens,
for the locals to assemble and block the road. However, since
omnibus allegation is there against the petitioner and an
undertaking has been given that he shall be diligently appearing
in trial, in that background, this Court is inclined to extend him
the privilege of anticipatory bail with conditions subject to
payment of Rs. 2,000/- to the Chief Minister’s Relief Fund
through Demand Draft and the receipt be submitted to the
learned trial Court.
