Patna High Court

RAMANAND SAH @ RAMANAND KUMAR SHAHversusTHE STATE OF BIHAR

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and sureties.

Summary

Ramanand Shah was arrested for allegedly secretly recording a video of a minor taking a bath and subsequently disseminating the footage. He faced charges under Sections 74, 77, and 3(5) of the Bihar Narcotic Substances Act, 2023, Sections 10, 12 and 15 of the POCSO Act, and Section 67 of the Information Technology Act. The petitioner argued that no physical assault was involved and highlighted his clean antecedent, having been in custody since 7 February 2025. The State opposed bail, citing the seriousness of the offences. The court, after considering the facts and the petitioner’s clean record, granted bail on a bond of Rs.10,000 with two sureties, subject to his cooperation with the trial.

Issues considered

  • Whether bail should be granted to the accused in offences under the POCSO Act, the IT Act and the Bihar Narcotic Substances Act despite the alleged voyeuristic act.
  • Whether the absence of physical assault and the petitioner’s clean antecedent justify bail.
