Patna High Court

Rahul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner under Section 438(2) of the CrPC.

Summary

The petitioner, Rahul Kumar, a 19‑year‑old with no criminal record, applied for anticipatory bail in a case involving alleged offences under Sections 399 and 402 of the IPC and Sections 25(1‑b)a, 26 and 35 of the Arms Act. The FIR alleged that he was named by co‑accused who had been arrested with a pistol, cartridge and knife. The petitioner contended that the allegations were false and that he was falsely implicated. The court considered his young age, clean antecedent and the nature of the accusations, and found no compelling reason to deny bail. Consequently, the court granted anticipatory bail, directing that if arrested within four weeks he may be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious nature of the alleged offences under the IPC and Arms Act
  • Whether the petitioner’s age and lack of prior criminal record warrant the grant of anticipatory bail

                                   2. This application, for grant of anticipatory bail,

arises out of Mahindwara Police Station Case No. 110 of 2022,

Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

                                   3. As per the FIR, the police got the information

name of the petitioner and others who succeeded in fleeing

          away.

                          4. Learned counsel for the petitioner submits that

the petitioner has falsely been implicated in this case on the

basis of statement made by the arrested co-accused persons.

Petitioner is aged about nineteen years having no criminal

          antecedent.

                          5. Having regard to the submissions made on

behalf of the parties and taking into consideration the fact that

the petitioner is having no criminal antecedent and he is of

tender age of nineteen years, I am inclined to grant the petitioner

          privilege of anticipatory bail.
