Patna High Court

Ravi KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail was not granted to the petitioner.

Summary

The petitioner, Ravi Kumar, applied for bail in a murder case (Sections 302, 120(B) and 34 IPC) arising from a dispute that led to the deceased being shot. The High Court noted that the petitioner had been in custody since July 2023 and that CCTV footage identified him and co‑accused firing at the victim. The trial is reportedly near conclusion, with eight of eleven witnesses already examined. The petitioner argued that the pending trial warranted bail, but the State opposed, emphasizing the seriousness of the offences and the risk of interference. The Court, after hearing counsel, found that the circumstances did not justify release on bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether bail should be granted to the accused in a murder case under Sections 302, 120(B) and 34 of the IPC.
  • Whether the progress of the trial and examination of witnesses warrants denial of bail.
