Patna High Court

Pawan Baitha @ Pavan BaithaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Pawan Baitha, was arrested in connection with a dowry death case under Sections 80(I), 238, 61(2) and 3(5) of the BNS. The prosecution alleged that the petitioner and others demanded dowry and, upon non‑payment, murdered the informant's sister and attempted to cremate the body. The petitioner, who is the husband of the deceased, argued that the primary witness did not support the prosecution and that the death was due to an ailment, and he has a clean antecedent. The State opposed bail, but the court considered the length of custody, the lack of corroborative evidence, and the petitioner's background. The court allowed regular bail on a bond of Rs.10,000 with two sureties, directing release pending trial.
