Patna High Court

Kaushal Kishore KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail subject to a bond of Rs.10,000 and two sureties, with verification of any other criminal antecedent.

Summary

Petitioner Kaushal Kishore Kumar was charged under Section 111 of the Bihar Narcotic Substances Act and Sections 8(C), 21(b) and 22 of the NDPS Act for the alleged recovery of 12.5 g of brown sugar from his aunt’s house. He pleaded innocence, arguing that the contraband was not in his conscious possession and that a co‑accused, Sonu Kumar Singh, had been granted regular bail in a similar case. The State opposed the bail application. The court considered the facts, the petitioner’s clean antecedent and the precedent of the co‑accused’s bail, and ordered that the petitioner be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to verification of any other criminal antecedent. The bail order also required the petitioner’s cooperation with the trial process.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the recovery of narcotics from a relative’s residence.
  • Whether the precedent of bail granted to a co‑accused in a similar case is applicable.
  • Whether bail can be granted under the NDPS Act and the Bihar Narcotic Substances Act in the present circumstances.
