Holding

The Court denied regular bail to the petitioner.

Summary

The petitioner, Dharmendra Rai, applied for regular bail in a case registered under Section 392 of the Indian Penal Code for alleged robbery of approximately Rs. 1,96,000 on 03.11.2017. The prosecution alleged that the petitioner was involved in the robbery and highlighted his involvement in 36 other serious cases, portraying him as a repeat offender. The petitioner contended his innocence and argued for bail, having been in custody since 03.06.2021. The learned counsel for the State opposed bail, emphasizing the gravity of the offence and the petitioner’s criminal antecedents. The Court, after considering the seriousness of the allegations and the petitioner’s prior cases, found no sufficient ground to grant regular bail. Consequently, the bail application was rejected, with a direction that the petitioner may reapply if the trial is delayed by the prosecution.

3 26-03-2026 Heard the learned counsel for the petitioner and

                   learned APP for the State.

                                2. The petitioner seeks regular bail in connection with

Desari (Chandpura) P.S. Case No. 259 of 2017 registered for the

offence under Section 392 of the Indian Penal Code.

                                3. As per the prosecution case, the petitioner is alleged

to have been involved in the robbery of cash (approximately Rs.

1,96,000/-) from the informant and his associate on 03.11.2017

                                4. Learned counsel for the petitioner submits that the

petitioner is innocent and has not committed any offence.

Petitioner is in custody since 03.06.2021.

                                5. Per contra, learned counsel for the State

vehemently opposes the bail application and submits that the

allegations against the petitioner are serious and grave in nature.
Patna High Court CR. MISC. No.5777 of 2026(3) dt.26-03-2026
                                                        2/2

He further submits that the petitioner is accused in 36 more

                      cases of serious nature.

                                   6. Considering the allegations levelled against the

petitioner as well as his criminal antecedents, this Court is not

inclined to grant regular bail to the petitioner.

                                   7. Accordingly, this application for regular bail stands

rejected. If the trial is delayed by the prosecution, the petitioner

may renew his prayer for bail.
