Provisional bail was granted subject to payment of the amount in instalments, a bail bond of Rs 1 lakh with two sureties, and verification of addresses.
Summary
The petitioner, Prabhat Kumar Ranjan, was charged with cheating Rs 20 lakh in a land‑sale fraud under sections 316(2), 319(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023, and has a history of over twenty similar cases. He applied for regular bail, offering to repay the entire amount in ten equal monthly installments and produced a demand draft of Rs 2 lakh as a show of bona‑fide. The State and the informant opposed the bail, arguing the seriousness of the offence and the petitioner’s prior record. The Court, after considering the repayment proposal, the demand draft, and the conditions proposed by the petitioner’s counsel, granted provisional bail subject to a bail bond of Rs 1 lakh with two sureties who are close relatives, verification of addresses, and compliance with the instalment schedule. The bail will remain provisional until the petitioner completes payment, after which it may be confirmed, and the case was re‑listed for further proceedings. Failure to adhere to the conditions would result in cancellation of bail.
Issues considered
- Whether the petitioner is entitled to regular/provisional bail despite the serious cheating charges and prior criminal history
- Whether the proposed repayment schedule and surety conditions satisfy the requirements for bail under the Bharatiya Nyaya Sanhita
