Patna High Court

Raghuvir KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, confirming the interim bail.

Summary

The petitioner, Raghuvir Kumar, was arrested in connection with a case registered under Sections 363, 366(A) and 34 of the Indian Penal Code for allegedly abducting an informant's daughter to force a marriage. The petitioner contended that he was falsely implicated, that he and the victim had subsequently married, and that the victim later died without any allegation of foul play against him. He asserted a clean antecedent, had been in custody since 06-06-2025, and pledged to cooperate with the investigation. The State opposed the grant of regular bail. After considering the facts, the Court held that there was no sufficient ground to deny bail and confirmed the interim bail by granting regular bail on the same bail bonds.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under Sections 363, 366(A) and 34 IPC.
  • Whether the death of the victim implicates the petitioner in a culpable offence warranting denial of bail.
