Holding

Anticipatory bail is denied to petitioner No.1 as the principal accused, but is granted to petitioner No.2 as no specific charge is made against her.

Summary

Petitioners Nandan Rishi and his wife Rinki Devi applied for anticipatory bail in a case alleging a Rs.1 crore scam under Sections 316(5), 318(4) and 61(2) of the Bihar Negotiable Instruments Act. The prosecution’s case primarily implicates petitioner No.1 for misappropriation of funds, while no specific charge is made against petitioner No.2. The Patna High Court held that anticipatory bail could not be granted to petitioner No.1 and ordered him to surrender within two weeks and apply for regular bail. Conversely, the Court allowed anticipatory bail to petitioner No.2, a woman, subject to a bail bond of Rs.10,000 with two sureties and conditions under CrPC Section 438(2) and Section 482 of the BNSS. The order was partially allowed, directing compliance by the Superintendent of Police.

Issues considered

  • Whether anticipatory bail can be granted to petitioner No.1 who is the main accused in the alleged scam.
  • Whether anticipatory bail can be granted to petitioner No.2, a woman, in the absence of a specific allegation against her.

for anticipatory bail of the petitioners.

                       6. Considering the fact that the main allegation of
