Patna High Court

Dharmendra PalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Dharmendra Pal, was arrested in connection with a kidnapping case (Bihta P.S. Case No. 607 of 2025) under Sections 137(2), 87 and 84 of the Bharatiya Nyaya Sanhita, 2023. He claimed innocence, asserted that the alleged victim had voluntarily eloped with him, and highlighted his clean antecedent and custody since 5 August 2025. The State opposed bail, while the petitioner’s counsel argued for regular bail. The court examined the victim’s statement indicating an elopement and considered the petitioner’s clean record. Consequently, the court allowed the regular bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • Whether regular bail should be granted to the accused in a kidnapping case under Sections 137(2), 87 and 84 of the Bharatiya Nyaya Sanhita, 2023, considering the alleged elopement and the petitioner’s clean antecedent.
