Binod Kumar Rai @ Bina Kumar RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, directing him to furnish a bail bond and sureties.

Summary

The petitioner, Binod Kumar Rai, applied for regular bail in a case registered under Sections 103(3)(5) of the BNS concerning the alleged murder of an informant's daughter. The prosecution alleged that four sisters-in-law and a brother-in-law killed the victim, with no direct accusation against the petitioner. The petitioner’s counsel argued that he is innocent, has a clean record, and has been in custody for about nine months without any specific allegation against him. The State opposed bail, but the court noted the FIR does not name the petitioner and considered the lengthy pre‑trial detention. Consequently, the court directed the petitioner to furnish a bail bond of Rs.10,000 with two sureties, granting regular bail subject to cooperation with the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner under Sections 103(3)(5) of the BNS despite the seriousness of the alleged offence
  • Whether the absence of any specific allegation against the petitioner in the FIR justifies bail
