Holding
The court held that the petitioner is entitled to regular bail subject to a bail bond and surety conditions.
Summary
Reena Devi was arrested in connection with a case involving arson and murder arising from a property partition dispute, where the prosecution alleged that she and other accused poured kerosene on the deceased and set her on fire. The petitioner pleaded innocence, citing a clean antecedent and the fact that the deceased's husband, who was examined as a witness, did not support the prosecution's case. The State opposed the bail application. The court considered the petitioner's claim of innocence, the lack of corroboration from the husband, and her clean record. It directed that bail be granted upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount, subject to conditions of cooperation with the trial. The petitioner was ordered to be released on bail.
Issues considered
- Whether the petitioner is entitled to regular bail despite being charged under Sections 341, 323, 326, 307/34 and 306 of the IPC
- Whether the petitioner's alleged innocence, clean antecedent, and lack of support from the deceased's husband justify granting bail
