BAIL GRANTED

Holding

The Court allowed the anticipatory bail application, granting bail subject to the conditions of Section 438(2) CrPC and Section 482 B.N.S.

Summary

The petitioner, Sita Devi, sought anticipatory bail fearing arrest in a murder case (Manikpur P.S. Case No. 32 of 2025) involving offences under Sections 126(2), 115(2), 85, 80 and 3(5) of the B.N.S. and Sections 3 and 4 of the Dowry Prohibition Act. The prosecution alleged that she and others killed the deceased, while the petitioner claimed innocence, stating she is the mother‑in‑law of the deceased, resides elsewhere, has a clean antecedent and was falsely implicated. The State opposed the bail. The Court, after considering the facts and the petitioner's clean record, allowed the anticipatory bail application, directing release on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 438 of the CrPC and Section 482 of the B.N.S.
  • Whether the petitioner is likely to be arrested in connection with the offences alleged.
  • Whether the petitioner's clean antecedent and claim of false implication justify granting bail.
